Tuesday's gains were fueled by solid earnings reports and a batch of large pharmaceutical deals.
The Dow Jones industrial average rose 65 points, or 0.4% to 16,514, according to preliminary calculations. The S&P 500 gained 8 points, or 0.4%, to 1,880 and is now only 10 points below its record closing high of 1,890.90. The Nasdaq composite index rose 39, or 1% to 4,161.
The market's gains over the past week have been driven by a combination of factors, said Phil Orlando, chief equity strategist at Federated Investors. "We were definitely oversold, there's no question about that," Orlando said. "Earnings, by and large, haven't been worse than we thought and the economic news has actually been a little better."

But what if that company has put together a hot streak of earnings beats? What if a company has beaten not just two or three quarters in a row, but 20 quarters in a row - or 5 years - without a miss? Apple (AAPL) had put together just such an impressive earnings surprise streak until it finally missed in late 2011. In the 6 quarters since the miss, it has missed another 3 times. Share price, however, peaked in between the second and third miss.
But during its earnings surprise streak, investors were handsomely rewarded. Perfection Isn't Easy Even with all of the unknowns in investing, I'd rather buy a company that is on an earnings hot streak, than one that is dead cold. Companies with a perfect earnings track record for the last 5 years are a small select group. It's incredibly difficult to keep beating for 5 years through all the ups and downs in the economy. What: Shares of consumer goods maker Jarden (NYSE: JAH ) jumped as much as 10% today after the company released earnings.
So what: Revenue was up 5.7% in the first quarter, to $1.58 billion, just beating the $1.56 billion estimate. The company did swing to a net loss of $4.4 million, but if you pull out one-time items, earnings were $0.30 per share, far exceeding the $0.23 estimate.�
- [By Will Ashworth] On September 3 Jarden (NYSE:JAH) announced it was acquiring Yankee Candle Company for $1.75 billion. Almost all the media I've seen since regarding the acquisition has been quite favorable. As I write this almost a full week has passed; the 10% uptick on the news is holding steady. It appears no one has a problem with this deal--except me. Read on and I'll explain why Jarden may be burning the candle at both ends.
The Deal's Positives
The company does a good job explaining why it's acquiring Yankee Candle. It comes down to six reasons:
1. Yankee Candle are market leaders in premium scented candles.
2. Its brand awareness results in repeat purchases providing recurring revenue.
3. It does well in good and bad economic cycles.
4. Free cash flow is strong and growing.
5. It will add 10% to its pro forma adjusted earnings per share and that's before any synergies.
6. It didn't have to go through a bidding war.
You don't have to be a rocket scientist to see that the deal boosts its margins in impressive fashion. Its adjusted gross margin will increase 320 basis points to 32.1% while its adjusted EBITDA margin improves 140 basis points to 13.2%. And all it has to do to achieve these improvements is to shell out $1.75 billion paid using cash on its books, new equity and some additional debt. In this low-rate environment it doesn't seem like a bad proposition. Especially if it can generate permanent cost savings through economies of scale, etc.
What it really brings to the table is top-line growth. In 2012, Yankee Candle's revenues increased by 7.4% year-over-year to $844.2 million. Meanwhile, Jarden's revenues in 2012 were flat year-over-year at $6.7 billion. Its 542 retail stores delivered same-store sales growth of 2.5% in 2012, which is more than respectable. One of the only ways to fight this is by getting bigger. A good example in another industry is Jarden (JAH), a consumer goods business with annual revenues of $7.4 billion. It�� as big as it is in order to be able to provide a larger assortment of products to Walmart (WMT), its biggest customer, representing 20% of overall sales. Without this wide assortment, Bentonville would have to go elsewhere for sales. The same scenario applies to cable and television content.

Recently, as I was going through the mail, I found a letter welcoming my wife as a new AT&T (T) customer. This struck me as odd since both my wife and I had been using a different carrier for more than 10 years. The letter indicated that my wife had opened an account with AT&T mobile and that she had purchased five iPhones and two iPads. "Honey," I yelled. "I think we have a problem." And we did. After contacting AT&T, we found out that someone, using my wife's information, had gone into one of its retail stores, opened an account in her name, purchased numerous items and walked out. After I informed AT&T that this was a case of fraud, the company immediately closed the account, informed us that we would not liable for the purchases and said it would remove the inquiries from my wife's credit report. A Second Theft No harm, no foul, I reasoned, making a mental note to sign up with the credit protection service LifeLock (LOCK). However, before I could, we received a letter from T-Mobile (TMUS). Yes, you guessed it, welcoming my wife as a new customer. The identity thieves had done the same thing. Again, T-Mobile was great, canceling the account and telling us we were not liable. However, now I knew we had a serious issue. I immediately called LifeLock and signed up myself, my wife and our two minor children to its service. I signed up my kids because a common variation on the identity theft scam is to steal and use the Social Security numbers of minors. Pacific Rubiales Energy Corp. (Pacific Rubiales) is a producerand seller of natural gas and heavy crude oil. The Company also purchases crude oil from third parties to be used as diluents and for trading purposes. The Company owns Meta Petroleum Corp. (Meta), an oil branch which operates the Rubiales/Piriri and Quifa oil fields in the Llanos Basin in association with Ecopetrol; and Pacific Stratus Energy Colombia Corp. (Pacific Stratus), which operates the wholly owned La Creciente gas field in the northern part of Colombia and other light and medium oil fields. In addition to its production assets, it has investment in oil pipelines in Colombia, including the Oleoducto de los Llanos S.A. Apart from the momentum traders, the growth seekers have to check it out too. Manitok Energy is another growth company with a non-existent coverage from the online publications, although it has been growing by leaps and bounds during the last couple of years. PowerShares Dynamic Networking Portfolio (the Fund) seeks investment results that correspond generally to the price and yield of an equity index called the Dynamic Networking Intellidex Index (the Networking Intellidex). The Networking Intellidex consists of stocks of 30 United States networking companies. These are companies that are principally engaged in the development, manufacture, sale or distribution of products, services or technologies that support the flow of electronic information, including voice, data, images and commercial transactions. These companies may include providers of telecommunications and networking equipment, data storage, systems software, Internet hardware, including servers, routers, switches and related equipment, systems for data encryption and security, Internet services, including hosting and commercial exchanges, fiber optics, satellites, cable equipment, and other companies involved in supporting the flow of information. Stocks are selected principally on the basis of their capital appreciation potential as identified by the AMEX (the Intellidex Provider) pursuant to its Intellidex methodology. The Fund will normally invest at least 80% of its total assets in common stocks of networking companies.
